Overview

Corrective Services NSW (CSNSW) within the NSW Department of Communities and Justice (DCJ) runs the State’s correctional centres, supervises offenders in the community, and delivers services and programs to reduce reoffending, support reintegration and build safer communities.

This document sets out the terms of use and privacy notice which govern your use of the ‘tap app’ smartphone application (Application). Please review this document carefully before using the Application.

In this document, when we use ‘we’, ‘us’ or ‘our’, we are referring to CSNSW. When we use ‘you’ or ‘your’, we are referring to the user as an individual.

Informed consent

By agreeing to this Terms of Use and Privacy Notice, you consent to use the Application voluntarily and in accordance with the terms set out in the document.

You will be using the Application for the duration of your EQUIPS program. On completion of your program, or period of case management you will no longer be able to access the Application.

If you disagree with the terms of use and privacy notice, you should close the Application and speak with your Community Corrections Officer regarding your concerns and suitability for using the Application.

The Tap App | Our vision and values

The Application has been designed to offer a safe and accessible space for you to rehearse and practice the skills learnt during facilitator guided EQUIPS program sessions or when working with your officer or caseworker. The Application is a resource for increasing skills and knowledge, promoting self-efficacy, enhancing wellbeing, promoting behaviour change and desistance from offending. We hope it also helps to provide you with more structure while enhancing the support you receive.

The Application works best when it is used regularly and openly. This requires trust. We undertake to treat the information you share in the Application as therapeutic in nature and collected through voluntary participation. Information you share on the Application will not be used against you (subject to mandatory reporting requirements).

Your responsibilities

You must keep your login details secure. You must not share these details with anyone else or allow someone else to use your account. You must not use someone else’s login details to access the Application. You must not:

  • use the Application for any unlawful purpose; or
  • hack or interfere with the Application in any way, including by distributing viruses or other similar software, or by collecting or storing information about other users of the Application.

We may lock, suspend, or terminate your access to the Application if you do not comply with these terms.

Disclaimers

While the information on this Application has been presented with all due care, CSNSW does not warrant or represent that the material is complete, current, reliable or free from error. Any links to third party websites that are included in the Application are provided for convenience and do not constitute endorsement of material on those sites or any associated organisation, product or service.

We do not accept any liability for any loss, damage, cost or expense you might incur as a result of using or relying on the information on this Application, or any linked sites.

Our contract providers

DCJ has engaged TeleResult Pty Ltd to host the Application and provide the necessary support and security infrastructure to store the data collected through the Application.

With the approval of DCJ, TeleResult Pty Ltd has sub-contracted to Stripy Sock Pty Ltd, an Australian mobile application development company, to develop the Application.

The Tap App | Your privacy

Keeping your personal information safe is important to us and your information is protected by a number of laws. It can only be collected, used, or disclosed by others, including us, if allowed by those laws or if you consent to it. The laws protecting your personal and health information, that we must comply with, include:

  • New South Wales - Privacy and Personal Information Protection Act 1998
  • New South Wales - Health Records and Information Privacy Act 2002
  • Australian Government – Privacy Act 1988

Privacy Management Plan

Our Privacy Management Plan provides more detail on what personal information is collected, how we meet our privacy obligations and uphold and respect the privacy of our customers, employees and others about whom we hold personal information.

What personal information will we collect from you?

We collect personal information and health information directly from you when you input your data into the Application. We will only collect personal information that is reasonably necessary and related to the operation of the Application and the administration of the EQUIPS program. Information that is collected may vary depending on the features you choose to utilise in the Application. The types of information we may collect include your:

  • Name, Date of Birth, MIN number
  • Phone number, email, home address
  • Sexuality, marital status, aboriginality, ethnicity
  • Employment
  • Religious affiliations, union membership, political beliefs
  • Locations frequented
  • Offence details and information about criminal acts, associates, criminal history
  • Information relating to AVOs or other court imposed conditions
  • Enrolment and participation details in CSNSW therapeutic services and programs
  • Details of CSNSW staff (i.e. facilitator/case manager)
  • Appointment details with medical practitioners, including mental health practitioners
  • Addiction-related information (drug and alcohol use)
  • Disability status, mental and physical health status of offender or other individuals, including family members
  • Information about advice provided by medical practitioners, including mental health practitioners about the offender or other individuals, including family members

How will we store your personal information?

Your information is securely stored and encrypted to ensure the upmost safety and confidentiality of user data.

Only authorised DCJ staff and authorised staff of contracted service providers will have access to your personal information.

We ensure that your personal information is not kept longer than necessary, and disposed of appropriately, in accordance with the law.

How will we protect your personal information?

The Application has been developed using a secure IT platform and we have taken reasonable security measures to protect your personal information from loss, unauthorised access, use, modification, disclosure or other misuse. For example, we use:

  • Multi-factor authentication to authenticate authorised DCJ employees and contracted providers with the authorised credentials and a legitimate business need before they access the data and our systems. This involves limiting the number of employees who may access our systems for the purpose of carrying out their work and protecting our systems and the data with passwords and passcodes
  • Physical measures, such as swipe card access to building and equipment security
  • Digital technology, such as data encryption and firewalls, to minimise unauthorised access to information

However, we cannot guarantee that no viruses or other harmful code will enter the Application. We do not warrant or represent that this Application or any linked sites, are free from anything which may damage any device used to access the Application.

How will we use and disclose your personal information?

We will only use and disclose your personal information for the purpose of administering the EQUIPS program and any related secondary purpose, for example undertaking quality assurance or where required by law This will also include sharing your personal information with external providers contracted by DCJ (i.e. your program facilitator) to deliver the EQUIPS program to you.

The Application has been developed to help you practice the skills you are learning in your EQUIPS program or when working with your officer or caseworker to help you achieve your goals. Just like any other program with CSNSW, you will share information with your program facilitator. The information provided by you helps the facilitator or caseworker to better respond to your individual needs and provide you with the necessary support. The information you share also allows your facilitator to adjust program delivery to help the group as a whole work better together.

We also maintain and use information collected about you for our internal administrative purposes, including for the purpose of managing our interactions with you.

If you require technical or IT support, your details may be shared with the Application Administrator for the purpose of resolving your issue.

We may also use your information within DCJ to plan, coordinate and improve the way we provide services.

Mandatory reporting

We must report a situation where we reasonably believe you are in danger or someone else is at risk of harm. In these situations, your safety and the safety of others is our main priority and only information relevant to the risk of harm will be shared with managers or relevant authorities.

All participants are reminded that information disclosed on the Application regarding serious un-sentenced charges will also be reported.

Notifications and messages

You can choose not to receive notifications from us by turning off notifications in your Application settings.

If you change your mind

You can change your mind at any time about whether we can collect, use, and share your personal information. This is called “withdrawing consent”.

If you withdraw your consent, we may not be able to administer the EQUIPS program through the Application. If this happens, we will support you to find assistance from other programs.

Updates

We may review and update this document to take into account new laws, technology and changes to our operations. You will receive an in-app notification when updates take place with an invitation to review the updated terms of use and privacy notice document. By using the Application after any updates are published, you agree to be bound by the new terms.
